Cameroon : The first civil chamber of the French court of cassation dismisses Douala’s International Terminal appeal

The civil chamber of the French court of cassation dismissed the appeal lodged by Douala International Terminal (DIT) against the decision of the Paris Court of Appeal dated 10 January 2023, to June 19th 2023.

 

 

 

 

Afrique54.net | On the 10th November 2020, the Port Authority of Douala was sentenced to pay 58.6 million Euro to the Douala International Terminal (DIT), a local company chaired by Bolloré as a compensation for the damages resulting from the alleged loss of opportunity in the call for tenders relating to the renewal of the concession agreement for the Port of Douala-Bonabéri. Last Wednesday 19th June, that decision was set aside by the court.

This was due to the irregular composition of the arbitration tribunal. The arbitration award earlier made was then suspended according to a press release signed by the director of communication and public relations of the PAD Simplice Minlo. It is important to note that the Head of State, President Paul Biya instructed the Director General of the PAD to take action on the matter.

The above mentioned decision actually puts an end to all the speculations about the operation of the container terminal, enabling it to resolutely pursue the collection of its share of the parking penalties wrongly withheld by DIT S.A.
